Terms

Terms of sale

These terms apply to every order placed on dearlume.shop. Please read them before you order; you can save or print this page at any time.

1. Who sells to you

The seller is CONFECÇÕES VIRGINIA CASTRO, LDA, Sítio Cadilhe, 4495-111 Amorim, Póvoa de Varzim, Portugal; NIPC and commercial registration number 503495387 (Conservatória do Registo Comercial); share capital €5,000.00; email support@dearlume.shop; phone +351 912 483 761. Dearlume is the brand under which the company sells.

We sell to consumers for their own use. We do not sell wholesale.

2. Products

Each product page describes the main characteristics of the item: pattern, size, number of pieces, material and care. Product images show the product design; the glaze, print and colour of each piece may vary slightly. Serving trays are meant for carrying cups, glasses, bottles and bowls; please place unwrapped food on a plate or in a bowl.

3. Prices and currencies

4. How a contract is made

  1. Add items to the cart and go to checkout.
  2. Enter your billing and delivery details and choose a payment method. You can check and correct everything before you continue.
  3. Tick the box to accept these terms and click “Place order and pay”. This is a binding order with an obligation to pay.
  4. We send an order confirmation by email. The contract is concluded when that confirmation is sent. The email contains the details of your order and a link to these terms.

Contracts can be concluded in English, German, Danish, French, Swedish or Dutch. We keep a copy of your order; you can see it in your account if you create one.

5. Payment

The payment methods available for your order are shown at checkout. Payment is taken when you place the order and is processed by the payment provider you choose; we never see or store your full card details. If a payment fails, the order is not accepted.

6. Delivery

We deliver to the countries of the European Union, the United Kingdom, Switzerland, Norway, the United States and Canada. Orders are usually dispatched within 1–3 business days; estimated delivery times are listed on Shipping & returns. Unless agreed otherwise, we deliver within 30 days of the contract at the latest. If we cannot deliver an item, we tell you straight away and refund any amount paid for it. The risk of loss or damage passes to you when you, or a person you name, receive the goods.

7. Right of withdrawal (14 days)

You may withdraw from the contract within 14 days without giving any reason. The period ends 14 days after the day you, or a third party you name (other than the carrier), take physical possession of the goods — for orders with several items delivered separately, of the last item.

To withdraw, tell us clearly — by email to support@dearlume.shop or by post to the address in section 1. You may use the model withdrawal form, but it is not required. It is enough to send your message before the period ends.

Effects of withdrawal: we refund all payments received from you, including the standard delivery cost, within 14 days of receiving your withdrawal notice, using the same means of payment, at no cost to you. We may withhold the refund until we have received the goods back or you have supplied proof of having sent them, whichever is earlier. Please send the goods back within 14 days of telling us. You bear the direct cost of returning the goods. You are only liable for any loss in value resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

8. Legal guarantee of conformity (3 years)

Under Decree-Law 84/2021 you have a legal guarantee of conformity of 3 years from delivery. A lack of conformity that appears within the first 2 years is presumed to have existed at delivery. You may ask for repair or replacement and, where the law allows, a price reduction or termination of the contract. Details are on Legal guarantee. These rights are free of charge and cannot be limited by these terms.

9. Complaints and dispute resolution

Write to us first at support@dearlume.shop. You can also use the electronic complaints book at www.livroreclamacoes.pt.

Alternative dispute resolution entity: CICAP — Centro de Informação de Consumo e Arbitragem do Porto, www.cicap.pt.

The authorities responsible for consumer protection in Portugal are the Direção-Geral do Consumidor (DGC) and the Autoridade de Segurança Alimentar e Económica (ASAE).

10. Law and courts

These terms are governed by Portuguese law. If you are a consumer living in another country, you keep the protection of the mandatory consumer law of that country. You may bring proceedings in the courts of the place where you live.

11. Changes

We may update these terms for future orders. The version that applies to your order is the one shown when you placed it.
